I went through an accident a couple of years ago (not with the bus) where a woman ran a red light and hit me in the front of my F250. I was advised that when the at-fault party’s insurance is paying for my repairs, I am actully BETTER OFF. Why? If your own insurance is paying, they will hold you to the letter of the “contract” you signed with them. That’s it. However, you have no such agreement with the other insurance. The burden is on them to make you happy. Your ability to successfully litigate is MUCH is better with the other company than it would be with your own. Nobody wants to litigate, and that other insurance company is much more likely to perform to keep you happy.

    Good Luck!

Dan so sorry to hear about your accident and happy that you and Judy and pups are ok. And now the battle begins as you already know. Depending on what insurance you have and the young lady have, it will get nasty, I can almost assure that her policy won’t be sufficient to cover your bus, so it will come down to your underinsured/no insurance. After that your insurance company will go after her company which then goes after her for payment. Hope it all works out in your favor and it may be a good time for a upgrade. Keep everyone posted!

Just this spring I had a situation where my at was totaled by someone else’s error. It took me two months of fighting with both the at-fault party’s carrier and then mine to get a settlement. It ended up coming from mine, mostly because my agent went up the chain to people in Chicago to get some satisfaction. In the end, I got 30% more by being persistent and fighting for everything.

My carrier DID try to stick to the letter of our contract which didn’t say much about the additional equipment I had installed. The other company just gave me a number and said take it or leave it. Had I not been of a mind to fight and of the means to do so I would have been screwed.
